Reina Marín SL is the owner or licensee of all intellectual and industrial property rights in its website and in the elements it contains. Accordingly, the reproduction, distribution, public communication and transformation of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, without the authorisation of Reina Marín SL under its Terms and Conditions, is expressly prohibited.

Trademarks, trade names and distinctive signs belong to Reina Marín SL, whether as industrial or intellectual property, and access to the Portal shall not be understood as granting any right over those trademarks, trade names and/or distinctive signs.

All products and services on these pages that are NOT owned by Reina Marín SL are registered trademarks of their respective owners and are recognised as such by our company. They appear on the Reina Marín SL website solely for promotional and information-gathering purposes. These owners may request the modification or removal of the information that belongs to them.

3. Terms of use of the portal

3.1 General

The User undertakes to make proper use of the Portal in accordance with the law and this Legal Notice. The User shall be liable to Reina Marín SL or to third parties for any damage that may be caused as a result of breaching this obligation.

It is expressly prohibited to use the Portal for purposes that harm the property or interests of Reina Marín SL or of third parties, or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of Reina Marín SL or of third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the law and this Legal Notice, as well as with any other terms, regulations and instructions that may apply in accordance with clause 1.

By way of example only, and in accordance with current legislation, the User shall refrain from:

• Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents, except where authorised by law or expressly consented to by Reina Marín SL or by whoever holds the exploitation rights, as the case may be.
• Reproducing or copying for private use any Contents that may be considered Software or a Database under current intellectual property legislation, as well as publicly communicating them or making them available to third parties where these acts necessarily involve reproduction by the User or by a third party.
• Extracting and/or reusing all or a substantial part of the Contents of the Portal, as well as of the databases that Reina Marín SL makes available to Users.

3.3 Links to the Portal

Internet users who wish to add links from their own websites to the Portal must comply with the conditions set out below; not being aware of them shall not exempt them from the liabilities arising under the law:

• The link may only point to the home page or main page of the Portal and may not reproduce it in any way (online links, copying of texts, graphics, etc.).
• In accordance with the applicable legislation in force at any given time, it is in all cases prohibited to establish frames of any kind that surround the Portal or allow the Contents to be viewed through Internet addresses other than those of the Portal and, in any case, when they are viewed together with content unrelated to the Portal in such a way that: (I) it causes, or may cause, error, confusion or deception among users as to the true origin of the service or Contents; (II) it constitutes an act of unfair comparison or imitation; (III) it serves to take advantage of the brand reputation and prestige of Reina Marín SL; or (IV) it is prohibited in any other way by current legislation.

• The page establishing the link must fully comply with the law and may under no circumstances contain or link to its own or third-party content that: (I) is unlawful, harmful or contrary to morality and good customs (pornographic, violent, racist, etc.); (II) leads or may lead the User to the false belief that Reina Marín SL endorses, supports, adheres to or in any way backs the ideas, statements or expressions, lawful or unlawful, of the linking party; (III) is inappropriate or irrelevant to the activity of Reina Marín SL in view of the location, contents and subject matter of the linking party’s website.

4. Disclaimer

4.1 Information

Reina Marín SL is not responsible for decisions taken on the basis of the information provided on the Portal, nor for any damage suffered by the User or third parties as a result of actions based solely on the information obtained on the Portal.

4.2 Quality of service

Access to the Portal does not imply any obligation on the part of Reina Marín SL to check for the absence of viruses, worms or any other harmful computer elements.

It is the User’s responsibility, in all cases, to have suitable tools for detecting and removing harmful computer programs.

Reina Marín SL is not responsible for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.3 Availability of the Service

Access to the Portal requires third-party services and supplies, including transmission over telecommunications networks whose reliability, quality, continuity and operation are not the responsibility of Reina Marín SL. Consequently, the services provided through the Portal may be suspended, cancelled or become inaccessible before or during the provision of the Portal service.

Reina Marín SL is not responsible for any damage of any kind suffered by the User as a result of failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during or before its provision.

4.4 Content and services linked through the Portal

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, “Linked Sites”). In these cases, Reina Marín SL acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI), and shall only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not disabled the link with due diligence. If the User considers that a Linked Site contains unlawful or inappropriate content, they may notify Reina Marín SL in accordance with the procedure and effects set out in clause 6, without such notification in any case entailing an obligation to remove the corresponding link.

The existence of Linked Sites shall in no case be taken to imply the existence of agreements with their owners or operators, nor a recommendation, promotion or identification of Reina Marín SL with the statements, content or services provided.

Reina Marín SL has no knowledge of the content and services of the Linked Sites and is therefore not responsible for any damage caused by the unlawfulness, quality, obsolescence, unavailability, error or uselessness of the content and/or services of the Linked Sites, nor for any other damage not directly attributable to Reina Marín SL.

6. Reporting unlawful or inappropriate activities

If the User or any other Internet user becomes aware that the Linked Sites lead to pages whose content or services are unlawful, harmful, degrading, violent or contrary to morality, they may contact Reina Marín SL, providing the following information:

• Personal details of the person reporting: name, address, telephone number and email address;
• A description of the facts that reveal the unlawful or inappropriate nature of the Linked Site;
• In the event of an infringement of rights, such as intellectual and industrial property rights, the personal details of the holder of the infringed right, where this is a person other than the person reporting.
• They must also provide the document proving the standing of the rights holder and, where applicable, the authority to act on behalf of the rights holder when this is a person other than the person reporting;
• An express statement that the information contained in the complaint is accurate.

Receipt by Reina Marín SL of the notification provided for in this clause shall not, in accordance with the LSSI, constitute actual knowledge of the activities and/or content reported.

They must also provide the document proving the standing of the rights holder and, where applicable, the authority to act on behalf of the rights holder when this is a person other than the person reporting.

7. Notifications

All notifications and communications made by the parties shall be valid by any means permitted by law. Those relating to this Portal shall be deemed effective, for all purposes, if made through the Portal itself.

8. Changes

Reina Marín SL reserves the right to make, without prior notice, any changes it deems appropriate to its website, and may change, remove or add both the content and services provided through it and the way in which they are presented.

Furthermore, these terms and conditions may change at any time. Changes shall take effect from the moment they are published.

Reina Marín SL is present on various social networks and platforms. Therefore, when accessing any of these or other networks, please bear in mind that the applicable terms of use are those established by each platform, in which Reina Marín SL does not intervene.

10. Governing law

This Legal Notice is governed in all respects by Spanish law. Provided that the applicable law allows the waiver of the statutory jurisdiction, the courts of Málaga are designated as the forum for settling any disputes, the user expressly waiving any other jurisdiction that may apply.

This English version is provided for information purposes only. In the event of any discrepancy, the Spanish version shall prevail.
